EzhostAI - Terms of Use

1. Description of Service

EzhostAI is an AI-powered assistant designed to help Airbnb hosts manage guest communications more efficiently. The Service integrates with the Airbnb platform (accessed via a web view within our app) and uses artificial intelligence to suggest draft replies to guest messages based on conversation context and host-provided listing details. Users review, edit (if necessary), and send these messages through the integrated interface.

2. Acceptance of Terms & Apple EULA

Your license to use the EzhostAI application ("Licensed Application") is granted subject to your prior acceptance of the Apple Licensed Application End User License Agreement ("Standard EULA"). These Terms supplement the Standard EULA. In case of any conflict between these Terms and the Standard EULA, these Terms shall prevail regarding the specific subject matter addressed herein (such as AI disclaimers and functionality limitations).

3. License Grant

Subject to these Terms and the Standard EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Service for your personal or internal business use on any Apple-branded products that you own or control, as permitted by the Apple App Store Usage Rules.

4. IMPORTANT DISCLAIMERS & LIMITATIONS

a. AI-Generated Content Disclaimer:

The Service utilizes artificial intelligence (AI) to generate suggested message replies ("AI Content"). AI CONTENT IS PROVIDED FOR INFORMATIONAL AND DRAFTING PURPOSES ONLY. It is intended as a suggestion to assist you, not as a definitive or final communication.

YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, EDITING, AND APPROVING ANY AI CONTENT BEFORE SENDING IT TO YOUR GUESTS. You retain full responsibility for the accuracy, appropriateness, tone, and potential consequences of any message sent using the Service.

We make no representations or warranties regarding the accuracy, completeness, suitability, reliability, or legality of the AI Content. AI models can generate incorrect, incomplete, biased, or inappropriate information.

WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY ARISING FROM YOUR USE OF OR RELIANCE ON AI CONTENT. You agree to hold us harmless for any claims, damages, losses, or issues arising from messages generated or suggested by the Service.

b. Functionality & Availability Disclaimer:

The Service relies on accessing and interacting with the Airbnb website and platform through technical means, potentially including injected scripts or web scraping techniques displayed within a web view component of the app.

AIRBNB MAY CHANGE ITS WEBSITE, PLATFORM, OR TERMS OF SERVICE AT ANY TIME WITHOUT NOTICE. Such changes may partially or completely break the functionality of EzhostAI, including its ability to retrieve conversation data, identify listings, or interact with the message interface.

WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION OF THE SERVICE. The Service's functionality is inherently dependent on external factors beyond our control, including the stability and structure of the Airbnb platform and your device's internet connectivity.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind regarding its functionality or uptime. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

We are not affiliated with, endorsed by, or sponsored by Airbnb, Inc.

c. Compliance with Third-Party Terms:

Your use of the Service to interact with Airbnb is also subject to Airbnb's Terms of Service, Privacy Policy, and other applicable policies.

YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR USE OF EZHOSTAI COMPLIES WITH ALL APPLICABLE AIRBNB TERMS AND POLICIES. Methods used by EzhostAI to access data (like script injection or scraping) may potentially violate Airbnb's Terms. You use the Service at your own risk regarding compliance with third-party terms. We disclaim any liability related to your violation of any third-party terms of service resulting from your use of EzhostAI.

5. User Obligations and Responsibilities

• You must provide accurate and up-to-date information, including specific details about your listings, for the AI to function effectively.
• You must ensure you have the necessary rights and permissions to manage the Airbnb accounts you access through the Service.
• You agree not to use the Service for any unlawful purpose or in violation of these Terms, the Standard EULA, or any applicable third-party terms (including Airbnb's).
• You are responsible for maintaining the confidentiality of your account credentials.

6. Subscription and Payment

Access to the core features of EzhostAI requires an active subscription. Subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's terms and conditions regarding payments, renewals, and cancellations. 7. Intellectual Property

These Terms are effective until terminated by you or us. Your rights under these Terms and the Standard EULA will terminate automatically if you fail to comply with any term. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms or discontinuation of the Service. Upon termination, you must cease all use of the Licensed Application and destroy all copies. Sections 4, 7, 8, 9, 10, 11, 12, and 13 shall survive termination.

10. NO WARRANTY (As per Standard EULA)

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR OUR AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION (INCLUDING BUT NOT LIMITED TO ISSUES ARISING FROM AI CONTENT OR SERVICE FUNCTIONALITY/AVAILABILITY AS DESCRIBED IN SECTION 4), HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall our total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00) or the total amount you paid for the subscription in the preceding six (6) months, whichever is greater. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
